Terms & Conditions
Use of facility:
I agree upon booking or entering the Ball360 facility, I will adhere to the rules and guidelines in place. I recognize that failure to do so may result in removal, or suspension from the venue. Actions resulting in removal from the premises will include; vandalism, inappropriate language, misuse of equipment, physical violence, or intimidating mistreatment of staff, disturbing the peace or abuse of other members or customers of any form.
Confidentiality
I recognize that anything you share with us is regarded as confidential, whether it is business or personal information. We undertake not to, at any time, either directly or indirectly, use or disclose any information you share with us.
Media Release
I authorize and grant Ball360 to take photographs and videos regarding my experiences with them
I grant Ball360 to use my photographs and videos on Facebook, Instagram and all social media platforms
I allow Ball360 to edit, alter, copy, or distribute the photographs and videos for social media advertising and marketing
I agree that the photographs and videos belong to Ball360
I understand that I will not receive any monetary compensation
Payments
I acknowledge that all online payments, direct debits, and credit card transactions will be made via Stripe / Simply Book me platforms. I agree to their terms and conditions and acknowledge that the transaction fees are set by Stripe.
I accept that failure to make payment or failure to have sufficient funds available at the time of the transactions that I may be liable for additional fees and charges at the full discretion of Stripe and/or Ball360.
Memberships
I agree that upon purchasing a membership I am abiding by the Ball360 terms and conditions, and agree to make all necessary payments as required. All memberships for a junior must be purchased by an adult / guardian.
I agree that upon purchasing any memberships that there is a minimum 3 month agreement.
Cancellations: I agree to provide a minimum one month notice on the cancellation of any membership. I agree that 25% of the monies remaining under the agreed minimum term commitment will not be refundable. The non-refundable monies cover business and administration costs incurred.
Bookings: I accept that sessions cannot be made further than two weeks in advance. I understand that all bookings should be made via the Ball360/SimplyBookMe platform.
Cancellations: I agree to provide a minimum of 24 hours’ notice for any cancellation to a booking, and failure to do so will mean the loss of monies or credit. (We do not provide refunds) Cancellations that are communicated more than 24 hours before the start of the booking can reschedule without loss of funds.
Gym
I understand that anyone under the age of 13 years or younger that are not having a PT session or 1 on 1 are required to have a parent or guardian with you at all times.
Academy Sessions
Athletes attending our academy sessions under the age of 13 will require an adult (parent, guardian or designated adult over 18 years) to sign in and out of the facility.
Orientation & Induction
I agree to undertake onsite orientation and induction with a Ball360 team member to ensure I understand the safe and appropriate use of all equipment and technology including our gym & wet areas.
Transfer of Memberships
I accept that I cannot transfer any funds, credits or bookings to any other individual, including family members and friends. If found to do so may result in loss of membership, suspension from venue, at the discretion of Ball360.
General
I agree that Ball360 may in our absolute discretion, change these terms and conditions from time to time without notice to you, and acknowledge that if any part of these terms and conditions are void, then the part that is void may be severed. I understand that any dispute arising out of these Terms and Conditions are governed by the laws of Victoria, Australia.
Waiver
I hereby give approval for myself and/or child to participate in any and all activities prepared by Ball360. In exchange for the acceptance of myself and/or said child’s candidacy by Ball360, I assume all risk and hazards incidental to the conduct of the activities, and release, absolve and hold harmless Ball360, and all its respective officers, agents, and representatives from any and all liability for injuries to said child arising out of traveling to, participating in, or returning from academy sessions.
I understand and voluntarily accept the risk and agree that Ball360 will not be liable for any injury including without limitation, personal, bodily or mental injury and economic loss. I consent to and authorize Ball360 to administer or arrange for appropriate medical treatment in circumstances. Where it is necessary.
I understand that Ball360 has the right to evict anyone who:
Has failed to follow the reasonable directions of the representative; or
Presents a hazard to the safety and wellbeing of any person including themselves.
Ball360 may monitor the facility to ensure all customers and staff safety and compliance with the agreement.
The Users must comply with all signs or other directions of Ball360 and it may suspend or cancel the users session and/or membership and be removed from Site for non-compliance with these conditions or for reckless or careless conduct to the facility and be responsible for any damages that occur within the facility through reckless conduct.
I understand that Ball360, or employees, representatives, independent contractors working for or in partnership with Ball360 and the facility cannot be held responsible in whole or in part for any accidents, illness or injuries resulting in medical or dental expenses incurred from attending Ball360.
I agree to waiver my rights to any and all claims, costs, liabilities and injuries incurred while within the venue. I agree to assume full and complete responsibility for any and all medical bills arising from attendance at the venue. In the event of any emergency, I authorize Ball360 to exercise its judgment in the treatment by a medical authority.
Medical Conditions: I agree to be forthcoming with any pre-existing or new medical conditions and/or injuries. Failure to communicate any condition, will waiver any liability on Ball360.
